Welcome to Sturgeon Spirits Craft Distillery. These Terms of Service ("Terms") govern your access to and use of our Facebook page, Facebook applications, website, services, and facilities (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

1. Acceptance of Terms

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. These Terms constitute a legally binding agreement between you and Sturgeon Spirits Craft Distillery. If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Age Restrictions and Eligibility

You must meet the following requirements to use our Services:

• You must comply with all applicable laws regarding the purchase and consumption of alcoholic beverages
• You must not be prohibited from receiving products or services under the laws of the United States or other applicable jurisdictions

By using our Services, you represent and warrant that you meet these eligibility requirements. We reserve the right to request proof of age at any time and may refuse service to anyone who cannot provide valid identification.

3. Facebook Integration

Our Services include integration with Facebook. When using our Facebook page or applications:

• You must comply with Facebook's Terms of Service and Community Standards
• You grant us permission to access your Facebook profile information as permitted by your privacy settings
• We may use Facebook's features including messaging, events, advertising, and analytics
• Your interactions on our Facebook page are visible to other users according to Facebook's privacy settings

4. User Accounts and Registration

When you create an account or register for events:

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You may not transfer your account to another person without our prior written consent

5. Acceptable Use

When using our Services, you agree NOT to:

• Violate any applicable laws or regulations
• Promote underage drinking or provide alcohol to minors
• Post false, misleading, or deceptive information
• Harass, threaten, or harm others
• Post offensive, defamatory, or inappropriate content

6. Events, Tours, and Bookings

Reservations and RSVPs

• Tour bookings and event RSVPs may require advance registration
• Capacity is limited and reservations are subject to availability
• We reserve the right to refuse service or cancel reservations at our discretion
• You must arrive on time for scheduled tours and events

Cancellation and Refund Policy

• Cancellations must be made at least 48 hours in advance for a full refund
• Cancellations within 48 hours may result in forfeiture of payment
• We reserve the right to cancel events due to weather, low attendance, or other circumstances
• If we cancel an event, you will receive a full refund or credit toward a future event

Venue Use and Event Spaces

• The Ready Room and facility rentals require separate booking agreements
• Venue capacity limits must be respected (45 for Ready Room, 110 for full facility)
• You are responsible for the conduct of your guests and any damages to the facility
• Additional terms and conditions apply to private event bookings

7. Payment Terms

• All prices are in U.S. Dollars unless otherwise stated
• Payment is required at the time of booking unless otherwise arranged
• We accept major credit cards and other payment methods as displayed
• You authorize us to charge your payment method for all fees and charges
• All sales are final unless otherwise stated in our cancellation policy
• Prices are subject to change without notice
• You are responsible for any applicable taxes, fees, or charges

8. Intellectual Property Rights

Our Content

All content on our Services, including but not limited to text, graphics, logos, images, videos, and software, is the property of Sturgeon Spirits Craft Distillery or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks, logos, or branding without authorization
• Create derivative works based on our content
• Remove or alter any copyright notices or proprietary markings

User-Generated Content

When you post content on our Facebook page or through our Services:

• You retain ownership of your content
• You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content
• You represent that you own or have permission to use the content you post
• You grant us the right to use your name and likeness in connection with your content
• We may use your reviews, photos, and feedback in our marketing materials

9. Disclaimers and Limitations of Liability

Service Provided As-Is

We do not guarantee that:

• The Services will be uninterrupted, secure, or error-free
• The information provided will be accurate or complete
• Any defects will be corrected
• The Services will meet your specific requirements

Limitation of Liability

Our total liability to you for any claims arising out of or relating to these Terms or the Services shall not exceed the amount you paid to us in the twelve months preceding the claim, or one hundred dollars ($100), whichever is greater.

Alcohol Consumption

You acknowledge that consumption of alcoholic beverages carries inherent risks. We encourage responsible drinking and provide educational information about our products. We are not liable for any harm resulting from alcohol consumption, including but not limited to injury, illness, or impaired judgment. Do not drink and drive.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sturgeon Spirits Craft Distillery, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Services, your violation of these Terms, your violation of any rights of another party, or your violation of any applicable laws or regulations.

11. Termination

We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Upon your request
• Extended period of inactivity

Upon termination, your right to use the Services will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Dispute Resolution and Arbitration

Informal Resolution

Before filing a claim, you agree to contact us and attempt to resolve the dispute informally. We will do the same if we have a dispute with you.

Binding Arbitration

If we cannot resolve a dispute informally, any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association. The arbitration shall take place in Winnebago County, Wisconsin. Each party shall bear its own costs and fees.

Class Action Waiver

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Winnebago County, Wisconsin, and you hereby consent to personal jurisdiction and venue therein.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our Facebook page and website with a new effective date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using our Services.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, such provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Services, constitute the entire agreement between you and Sturgeon Spirits Craft Distillery regarding your use of the Services and supersede all prior agreements and understandings.

17. Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

18. Assignment

You may not assign or transfer these Terms or your rights or obligations hereunder without our prior written consent. We may assign these Terms to any affiliate or in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets.

19. Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
